Now he\u2019s hoping to recruit more ordinary people to the role&nbsp;<\/h4>\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/jomec.co.uk\/thecardiffian\/wp-content\/uploads\/2020\/01\/image-1024x768.jpeg\" alt=\"\" class=\"wp-image-38800\" \/><noscript><img decoding=\"async\" src=\"https:\/\/jomec.co.uk\/thecardiffian\/wp-content\/uploads\/2020\/01\/image-1024x768.jpeg\" alt=\"\" class=\"wp-image-38800\" \/><\/noscript><\/figure>\n\n\n<p>YOU can blame the weather for how a Barry window cleaner ended up running the organisation that looks after South Wales\u2019 magistrates.&nbsp;<\/p>\n\n\n<p>Most days,&nbsp;John&nbsp;Viney&nbsp;runs a cleaning business.&nbsp;So&nbsp;when it rained and he couldn\u2019t work, he went to magistrates court.&nbsp;<\/p>\n\n\n<p>\u201cI&nbsp;used to sit in the back and was fascinated by the cut and thrust of the prosecution and the defence, trying to decide: did the person do it?\u201d&nbsp;<\/p>\n\n\n<p>After finding out through a friend that he didn\u2019t need a law degree to join, he applied for the role and became a magistrate in 2003. He now runs&nbsp;Magistrates\u2019 Association executive committee for Mid and South Glamorgan&nbsp;as well as being&nbsp;one of about 250 magistrates in Cardiff.&nbsp;&nbsp;<\/p>\n\n\n<p>The role is important, but sometimes hard to explain. Mr Viney, 67,&nbsp;tells of one colleague explaining it to a friend, to the reply: \u201cAll right, so you send people to prison as a hobby!\u201d&nbsp;<\/p>\n\n\n<p>What strikes me meeting&nbsp;him&nbsp;is how much he values both humour and law. And humour is the first quality he mentions when I ask what makes a&nbsp;really good&nbsp;magistrate.&nbsp;&nbsp;<\/p>\n\n\n<p>\u201cWe do&nbsp;a lot of laughing,\u201d he says.&nbsp;<\/p>\n\n\n<p>\u201cNot at defendants, not at victims, obviously, not at people. But at situations that you get.&nbsp;So&nbsp;we have a sense of humour and ability to have empathy \u2013 but a strength to realise that at times you need firmness.&nbsp;<\/p>\n\n\n<p>\u201cBecause without the law, we are lost.\u201d&nbsp;<\/p>\n\n\n<p>It\u2019s a lot of responsibility. Magistrates are volunteers in charge of the lowest criminal courts in the country. 95% of cases pass through magistrates\u2019 court, Mr Viney says, including the most serious like rape, arson or murder.&nbsp;&nbsp;<\/p>\n\n\n<p>Some go on to Crown Court, some are decided by magistrates, who can give jail sentences up to six months and&nbsp;sometimes, unlimited fines.&nbsp;<\/p>\n\n\n<p>And even then, he says,&nbsp;\u201cyou have to decide what&#8217;s going to happen to this person before it goes to Crown Court. Are they okay to be let out? And are they going to turn up?&nbsp;<\/p>\n\n\n<p>\u201cYou have to wonder whether you take their liberty away even before they&#8217;re found guilty or innocent.&#8221;&nbsp;<\/p>\n\n\n<p>Magistrates can specialise in youth court or family court. Applications are considered twice a year, and as a result people could apply anytime and only wait a couple of months.&nbsp;<\/p>\n\n\n<p>The first intake of new magistrates who interviewed straight into family court has recently been appointed, after restrictions were relaxed \u2013 there simply aren\u2019t enough family&nbsp;magistrates.&nbsp;<\/p>\n\n\n<p>\u201cThe family work has gone through the roof \u2013 the amount of families splitting up, abused children, children in danger, family circumstances, mum and dad splitting up, disputes over who&#8217;s having the kids&#8230;\u201d. And family cases can take up to three days.&nbsp;<\/p>\n\n\n<p>Despite concerns, they have been appointed and \u201cthe general consensus is that it\u2019s worked very well\u201d.&nbsp;<\/p>\n\n\n<p>This is why&nbsp;we\u2019re here \u2013 Cardiff needs new magistrates.&nbsp;&nbsp;<\/p>\n\n\n<p>A few obstacles make recruitment more difficult and magistrate numbers lower \u2013 a period of about five years, until about four years ago, where there was no recruiting, combined with an aging magistracy, as well as a pressurised financial climate.&nbsp;<\/p>\n\n\n<p>\u201cYou have to retire from being a magistrate when you&#8217;re 70.&nbsp;So&nbsp;the balance of younger to older magistrates is completely skewed, there&#8217;s something like 70% of magistrates over 55 or 60. We&#8217;re an older population.&nbsp;So&nbsp;as people are retiring, and we&#8217;re not getting newer ones come through, there&#8217;s more work for people to do. But we&#8217;re not quite getting the flow of magistrates.&#8221;&nbsp;<\/p>\n\n\n<p>More diverse magistrates \u2013 younger people, people with disabilities, people of colour are especially needed, so that people are judged by their peers.&nbsp;<\/p>\n\n\n<p>In April 2019, only 12% of magistrates were BAME. Only 5% were under 40 years old, but 52% were over 60 \u2013 this figure worries Mr Viney.&nbsp;<\/p>\n\n\n<p>The financial climate has made a difference, too, to how many people volunteer.&nbsp;&nbsp;<\/p>\n\n\n<p>\u201c20 or 30 years ago, if you had a magistrate working for you, that was quite a feather in the cap \u2013 to have a magistrate working for you was deemed to be quite a privilege.&nbsp;<\/p>\n\n\n<p>\u201cAs we now face financial constraints, employers are less inclined to give time off. They are less inclined to look at their magistrate as a benefit to their workforce, although we are&nbsp;actually better&nbsp;employees. But they&#8217;re less likely to see it that way. There&#8217;s more pressure on employers not to give time off for things like voluntary work as magistrates.\u201d&nbsp;<\/p>\n\n\n<p>Still,&nbsp;Mr&nbsp;Viney still pinches himself at the opportunity.&nbsp;<\/p>\n\n\n<p>\u201cIt is a great privilege, being able to put the initials JP after your name.&nbsp;&nbsp;<\/p>\n\n\n<p>\u201cYou&#8217;ve got to do it for the right reason, and you got to be prepared to put the time in.
