{"id":4790,"date":"2015-02-20T14:49:44","date_gmt":"2015-02-20T14:49:44","guid":{"rendered":"http:\/\/cardiffian.jomec.co.uk\/?p=4790"},"modified":"2015-02-20T14:49:44","modified_gmt":"2015-02-20T14:49:44","slug":"cardiff-drivers-may-be-owed-refunds-on-their-parking-fines","status":"publish","type":"post","link":"https:\/\/cardiffjournalism.co.uk\/thecardiffian\/2015\/02\/20\/cardiff-drivers-may-be-owed-refunds-on-their-parking-fines\/","title":{"rendered":"Cardiff drivers may be owed refunds on their parking fines"},"content":{"rendered":"<p>The RAC Foundation say Cardiff drivers may be among millions of drivers<a href=\"http:\/\/cardiffian.jomec.co.uk\/wp-content\/uploads\/2015\/02\/h0_parking_web.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\" size-medium wp-image-4809 alignleft\" src=\"http:\/\/cardiffian.jomec.co.uk\/wp-content\/uploads\/2015\/02\/h0_parking_web-252x300.jpg\" alt=\"h0_parking_web\" width=\"252\" height=\"300\" \/><noscript><img decoding=\"async\" class=\" size-medium wp-image-4809 alignleft\" src=\"http:\/\/cardiffian.jomec.co.uk\/wp-content\/uploads\/2015\/02\/h0_parking_web-252x300.jpg\" alt=\"h0_parking_web\" width=\"252\" height=\"300\" \/><\/noscript><\/a>\u00a0charged illegally for private parking fines.<br \/>\nIn a report published today, the RAC foundation outlined millions of pounds of parking penalties could have been charged illegally on private land across the England and Wales.<br \/>\nThe foundation has asked for the argument to be tested in court and has urged the government to ensure extra car parking charges are reasonable and enforceable.<br \/>\nExperts believe\u00a0overcharging in private parking penalties may have reached \u00a3100 million in 2013 alone, leaving millions of motorists in line for parking refunds.<br \/>\nBarrister John De Waal QC conducted a study for the foundation and found the sums handed over in fines by drivers often exceed any recompense for any genuine loss.<br \/>\nStephen Glaister, RAC Foundation director, said: &#8220;We would like to see this legal argument tested in a higher court so that a binding precedent is set.<br \/>\n&#8220;At the same time we would like the government to do what it should have done at the outset and set out what are reasonable charges.&#8221;<br \/>\nHe continued: &#8220;Ministers thought that the ban on clamping would end parking problems on private land. As we warned at the time, they were wrong.<br \/>\n&#8220;They allowed a system of ticketing to emerge which is barely regulated.
