The 40-year-old told magistrates she had no intention of driving after a night out with friends<\/strong><\/h4>\n\n\n\n

A MOTHER-of four\u2019s night out with friends landed her in court after Cardiff police found her “clearly intoxicated” behind the wheel .<\/p>\n\n\n\n

Darna Hickey, of Heathwood Road, Heath, failed to provide a specimen after a police officer found her in a car on Allensbank Road, Cardiff, at 2am on January 28, 2023.<\/p>\n\n\n\n

Prosecutor Stephen Head told Cardiff Magistrates Court her unsuccessful attempts to provide a specimen were \u201cprobably due to a level of intoxication\u201d.<\/p>\n\n\n\n

The 40-year-old had been out with friends and a personal matter \u201clead to her being quite upset\u201d, said Matthew de Maids, defending.<\/p>\n\n\n\n

Hickey had gone to the car because of what had happened when a police officer found her in the driver\u2019s seat, said Mr de Maids.<\/p>\n\n\n\n

The police officer thought Hickey was \u201cclearly intoxicated\u201d, said Mr Head.<\/p>\n\n\n\n

However, Hickey did not drive and had no intention of driving, Mr de Maids told the court.<\/p>\n\n\n\n

\u201cThere was no driving here,\u201d he said.<\/p>\n\n\n\n

The police officer decided she should be breathalysed but she did not comply, the court heard.<\/p>\n\n\n\n

The court was shown footage of a police officer attempting to breathalyse Hickey in the police station.<\/p>\n\n\n\n

Mr Head said: \u201cI don\u2019t think it was a deliberate refusal, I think it was an incapable refusal.\u201d<\/p>\n\n\n\n

Hickey pleaded guilty to failing to provide a specimen as someone in charge of a vehicle.<\/p>\n\n\n\n

Mr de Maids stressed that Hickey had no previous convictions and needed her driving licence to be able to take a family member for their weekly shop.<\/p>\n\n\n\n

\u201cShe is mortified that she has put herself in this situation,\u201d said Mr de Maids.<\/p>\n\n\n\n

Magistrate Patricia Blackwell said that 10 penalty points on Hickey\u2019s licence was \u201can appropriate punishment\u201d.<\/p>\n\n\n\n

Hickey was also ordered to pay a total of \u00a3645, including a \u00a3400 fine, \u00a385 prosecution costs and a \u00a3160 surcharge.<\/p>\n","protected":false},"excerpt":{"rendered":"
